1. Research Use Only / Not for Clinical Use

VFDistiller is a bioinformatics research and teaching tool for the
processing, conversion and annotation of genetic variant files (VCF,
gVCF, 23andMe raw format, FASTA). It is explicitly:
* NOT a CE-marked in-vitro diagnostic medical device (IVD) within
the meaning of Regulation (EU) 2017/746 (IVDR).
* NOT certified by BfArM, a notified body or any other regulator.
* NOT intended for clinical diagnosis, prognosis, therapeutic
decision-making, or the interpretation of clinical test results
(including in the consumer-genomics context).
* NOT a medical opinion, diagnosis or recommendation.
The ClinSig values (from ClinVar), variant-impact predictions (from
Ensembl VEP, AlphaGenome) and allele-frequency annotations (from
gnomAD, ALFA, TOPMed) that VFDistiller displays are database
annotations reproduced from third-party research sources. They are
for scientific orientation only and must not be used as a basis for
clinical decisions.
Any person using VFDistiller to interpret real human genetic data must
consult qualified human-genetics professionals.

2. No Medical Device / Kein Medizinprodukt

Zweckbestimmung (German, binding for the European market):
VFDistiller ist ein bioinformatisches Desktop-Tool zur technischen
Verarbeitung, Format-Konvertierung und Annotation genetischer
Variantendaten. Die Software ist ausschließlich für Forschung,
Lehre und Software-Entwicklung bestimmt. Sie ist KEIN
In-vitro-Diagnostikum, KEIN Medizinprodukt und darf weder für die
klinische Diagnose noch für therapeutische Entscheidungen
verwendet werden.

3. Liability / Haftung (Schenkungshaftung)

VFDistiller is distributed free of charge as an unentgeltliche
Open-Source-Schenkung (§§ 516 ff. BGB). Liability is limited to
intent and gross negligence in accordance with § 521 BGB and
§§ 15–17 AGPL-3.0. Liability for damage to life, body and health
remains unaffected under German mandatory law.
The Product Liability Directive (EU) 2024/2853 contains an
open-source exception (Art. 4 (3)); its applicability to software
distributed via commercial app stores is legally disputed and not
guaranteed here.
